It is possible. But being that there is no physical damage, you may be ok. Many lawyers know about kenetics. The forces that a+b=whiplash. They would say that she could have gotten whiplash by doing a hard stop.
The mechinism of injury isnt there!!!!
this is a sueing country. people will sue over the slightest things today.i would contact my insurance agent and see where you stand at.sounds to me like she is just trying to get some money. contact your agent and have them to deal with it. they will get the information off of the state police and her insurance company. who knows maybe she don,t have insurance.
If she was serious about pressing charges, she would have gone in the ambulance.
I don’t know what state you are in, but going in the ambulance is the best way to make the claim stick because it’s documentation of any injuries. If there were any internal injuries, the hospital would have found them.
Contact the officer who called the ambulance if possible if you have any questions.
Any decent insurance company solicitor/approved medical specialist will see right them. The fact they wouldn’t get in the ambulance and said they’ve had whiplash before will probably go against them. The bad part is you’ll probably get done for careless driving now purely because the other party called the police. If they hadn’t you could have exchanged insurance details and let them worry about it.
You will NOT have to pay any medical costs yourself, your insurance will. I realise it won’t cheer you up but it’s pointless worrying about how much the claim is for or whether it’s a acon because they will claim off your insurance whatever happens and your insurance will almost certainly pay them out. Regardless of whether this is £200 or £2000 it’s a claim whatever happens so try not to let it worry you too much.
Your insurance will rise slightly for the next year or so unfortunately so again easy to say but don’t worry because sitting their fretting won’t make next year’s insurance or the thrid party’s claim against you any cheaper.
If nothing else you will have learnt a lesson to concentrate better and I expect you’ll never do this kind of thing again so don’t worry too much and look at the bigger picture: no-one’s seriously injured or dead.
*Sorry, just in case it’s different in other countries my comments were based on the accident happening in Britain.
Now you know why they teach and recommend that you always maintain a safe following distance – minimum of 2 car lengths or 3 seconds following time whichever is greater!
And – recommend stopping a full car length behind cars stopped at an intersection… because there are evil bloodthirsty lawyers who will sue you until your teeth fall out for exactly what you did!
Get your insurance company involved ASAP! Get copies of the police report and, make certain it shows that she refused immediate medical treatment.
You are at fault!
Pray that you get a fair and reasonable Judge.
Learn from your mistake.
You stop worrying, you turn it over to your insurance company and you let them deal with it, this is what you pay them for. The worst that can happen to you in this case is that you are going to see and increase in your insurance which you will deal with.
