if it was his left shoulder it could have been from the impact of the rear collision…..

    People will sue for anything.

why is he speaking up now if the accident was 2 yrs ago?

The only way he can claim it after the statue of limitations time has passed, is if he can prove with medical documentation that his injury occurred solely by this car accident and not from anything else, and ALSO that he did not have any signs or symptoms of said injury until recently, or until after the statue of limitations has passed. The doctor would basically have to say… "I can tell by the way the bone of your shoulder is healing that you were injured approximately three years ago from an impact hitting at approximately this speed, and this impact hit from behind." ….Highly unlikely. He has no case.

He doesn’t have a case and he won’t go after you for shoulder pain. The cost of lawyers, the medical costs, and everything else to determine the cause of pain and court costs will be too high to make a case reasonable for pursuing.

He can threaten to sue you, and he might also be able to file a complaint but your attorney should be able to get it dismissed by affirmatively asserting a statute of limitations defense.

There is a recession. This guy may have lost his job or he may have difficulty paying his bills. This is why claims and lawsuits of this nature spike during bad times. He may even know that you got injured and figures you’ll be coming into some money that he can get his hands on.

You just have to wait and see what happens. If he sues you, then you will have to get a good attorney to defend it aggressively.

    Good luck.

Well, you should simply hire an attorney. If you had a license, the insurance company would have handled it, they still might. But I dobt it, you are going to be on the hook.

what does becoming a "forensic anthropologist" have to do with anything? You had a major collision, and you think there won’t be injuries?

Instead of asking what he is trying to pull, why not answer the same question yourself – you were driving entirely illegally by your own admission, and you won’t take responsibility for anything. What are YOU trying to pull?

Edit – the doctor didn’t say you were "this close to cracking your head off". Stop making stuff up if you want to be believable. You are already a horrible driver, involved in 2 accidents, driving without a license, etc. Don’t be a liar looking for sympathy – if you are studying even basic biology you would know that heads don’t snap off, and when serious neck injuries occur, quadriplegia is the result.

You are not smart enough to make stuff up and get away with it, and that is why you are not smart enough to see how someone could be hurt in a collision.
